Terms of Service

1. Agreement to Terms

By requesting a freight quote, signing a rate confirmation, or making a payment to AxisFreight LLC ("AxisFreight," "Company," "we," "us," "our"), you ("Customer," "Shipper," "you") agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Services Provided

AxisFreight provides commercial freight transportation and logistics services including but not limited to Full Truckload (FTL), Less-Than-Truckload (LTL), hotshot/expedited trucking, flatbed, oversized, and refrigerated shipping within the 48 contiguous United States. Service scope is defined in the rate confirmation issued per shipment.

3. Customer Responsibilities

By using our services, you agree to:

• Provide accurate shipment information including weight, dimensions, freight class, and commodity description.
• Ensure freight is properly packaged and labeled prior to carrier pickup.
• Notify AxisFreight of any hazardous materials (HAZMAT) in compliance with DOT regulations before booking.
• Have authorized personnel available at the pickup and delivery locations during the confirmed time window.
• Pay all invoices and charges by the agreed due date.
• Not ship prohibited commodities including illegal substances, live animals (without prior arrangement), or items prohibited by federal or state law.

4. Billing & Payment Terms

• First-time shippers: Payment is due in full before dispatch. We accept ACH transfer, credit card, and wire transfer.
• Established accounts: Approved credit accounts are invoiced Net-15 from the invoice date.
• Late payments: Invoices unpaid after the due date accrue interest at 1.5% per month (18% annually).
• Disputed invoices: Must be disputed in writing within 10 days of the invoice date. Undisputed portions remain due.
• All prices are in U.S. dollars. Fuel surcharges, accessorial fees, and applicable taxes are included in or itemized on the rate confirmation.

5. Delivery Timelines

Transit times quoted are estimates based on standard operating conditions. AxisFreight is not liable for delays caused by weather events, natural disasters, traffic incidents, acts of government, shipper or consignee unavailability, or other force majeure events. Expedited service timelines are best-effort commitments, not guaranteed delivery windows unless explicitly stated in writing.

6. Liability & Claims

AxisFreight's liability for cargo loss or damage is governed by the terms of the Bill of Lading and applicable federal law (Carmack Amendment, 49 U.S.C. § 14706). Claims for freight loss or damage must be filed in writing within 9 months of delivery. AxisFreight's liability is limited to the actual value of the cargo as declared, not to exceed carrier liability limits.

7. Chargeback Policy

Customers agree to contact AxisFreight directly at billing@axisfreight.com before initiating any chargeback or payment dispute with their bank or card issuer. Fraudulent chargebacks for services rendered will be disputed and may result in account suspension and referral to collections.

8. Termination

AxisFreight reserves the right to refuse service to any customer, cancel a booking prior to pickup, or terminate an account for non-payment, fraudulent activity, providing false shipment information, or violation of these Terms.

9. Governing Law

These Terms are governed by the laws of the State of Texas, USA. Any disputes shall be resolved in the courts of Dallas County, Texas, unless otherwise required by federal law.
